Terms and Conditions for online lessons

Hitoritabi Language Tuition (“Hitoritabi”) is a service that provides General Italian, General Japanese and Conversational Italian lessons online, via the Internet through audio or/and video call. The lessons consist of 50 minute long classes for individuals.

1 Cancellations

Students may cancel a lesson by actual [written] notice to Hitoritabi at least 24 hours in advance of the scheduled time for the lesson and Hitoritabi will allow the student to reschedule the lesson at no additional charge, subject to Hitoritabi’s availability. If Hitoritabi does not receive a cancellation notice at least 24 hours in advance or if the student fails to appear for a lesson, Hitoritabi shall have no obligation to reschedule a replacement of the lesson. Students are not entitled to refunds for lessons, including pre-paid lessons, if the student does not appear for the lesson or if Hitoritabi receives notice of the cancellation less than 24 hours in advance. A student who cancels a lesson at least 24 hours in advance may receive a full refund if the lesson is not rescheduled. Notice is deemed to be given when it is actually received by Hitoritabi, whether in writing, including email or text message or by telephone call.

2 Lateness for lessons

Students should always be on time for lessons. Where a delay of 10 minutes or more is anticipated by the student, Hitoritabi requires 30 minutes (half an hour) notice to be given in advance. Lessons will be rescheduled where possible. Where students are more than 10 minutes late to a lesson without prior notification, Hitoritabi reserves the right to cancel the lesson without refund.

3 Limitations of delivery of online lessons

All online lessons are delivered subject to connection quality and adequate connection speed as well as the availability of the software packages agreed upon by Hitoritabi and the student. Should the delivery of an online lesson be abandoned for technical reasons, Hitoritabi may, in Hitoritabi’s discretion, add up to 20 minutes of teaching time to the subsequent lesson. Unless otherwise agreed, it is not possible for students to claim any refunds for pre-paid lessons citing the connection quality or speed, as this will have been ascertained and deemed acceptable during the trial lesson period.

4 My cancellations

Hitoritabi always strives to be available for all of the scheduled lessons but will strive to provide advance notice of any cancellations. In the event that Hitoritabi cancels a lesson, whether or not notice is given, the lesson will be rescheduled. In extenuating circumstances, advance notice of cancellation by Hitoritabi may not be possible and students must accept lessons may need to be cancelled on the same day of the lesson.

5 Regular Lesson Slots

Hitoritabi is dedicated to providing students with regular lesson slots, but please note that availability is not guaranteed. Hitoritabi will make good faith efforts to accommodate such requests, but the lack of availability for a preferred slot is not an acceptable reason for a refund.

6 Sharing lessons with Third Parties

1 to 1 lessons can only be for one person at one time. As lessons are tailored to the individual, they may not be shared with a third party. Each new student will be required to contact Hitoritabi and arrange to purchase a new lesson for their own benefit.

7 Refunds

Refunds for lessons will be given only in accordance with the cancellation terms above.

8 Payment Terms

Payments shall be arranged using the PayPal services or Bank Transfer services.
Invoices for all lessons are payable in advance using the agreed payment methods, and students will receive an invoice to confirm the date of the agreement. Hitoritabi reserves the right to cancel any lessons after the first paid lesson at any time until payment is received in full by Hitoritabi for additional lessons.

9 Limited Liability

Hitoritabi makes no representations or warranties regarding the results that students may achieve as a result of hiring Hitoritabi as a teacher. Hitoritabi shall have no liability for a student’s failure to achieve desired goals or to attain the student’s desired results while studying with Hitoritabi as a teacher.

10 Copyright of materials

Hitoritabi retains the copyright of all tuition materials and recorded lessons provided unless otherwise stated. Tuition materials may be used freely for educational, non-commercial purposes only. All materials used must be accredited to Hitoritabi. Organisations and individuals wishing to use such material for any other purpose should contact Hitoritabi.

Changes to these Terms and Conditions

Hitoritabi reserves the right to change, modify, revise or otherwise amend any provision of these Terms and Conditions, and any other terms, policies or guidelines governing tutoring services provided by Hitoritabi, at any time at Hitoritabi’s sole discretion by providing notice that the Terms of Use have been modified. Such notice may be provided by sending an email, or by posting a notice on Hitoritabi’s website (http://hitoritabi.it) (the “Site”), or by posting the revised Terms and Conditions on the Site and revising the date at the top of these Terms and Conditions or by such other form of notice as determined by Hitoritabi. Your continued use of tutoring services or your purchase of any tutoring services following the posting of the revised Terms and Conditions or other notice will constitute your acceptance of such changes or modifications. Otherwise, any changes or modifications will be effective within thirty (30) days of the posting of the revisions on the Site unless you notify Hitoritabi within such 30 days that you do not agree to the changes and stop using Hitoritabi’s services.
